The Tobacco Conspiracy: Investigative Documentary Challenges Industry Lies

And that’s most often done using lots of money. As an example, this documentary looks into how tobacco companies use hidden product placement as a means of evading advertising regulations. Because cigarettes are heavily taxed, the government is constantly at war with itself. The taxation provides a heavy and consistent flow of revenue. Yet there are severe health implications that result from tobacco use.

The Tobacco Conspiracy also sheds light on the international smuggling role the industry plays. As smugglers infiltrate poor companies, they distribute free cigarettes to young people with the specific goal of getting them addicted. Once they are, the smugglers then charge money for the smokes. The tobacco companies then approach the poor country’s government and explain how much revenue is lost, and offers to distribute the cigarettes in order to provide a consistent flow of money.

Dissolvable Tobacco Products Especially Appealing to Kids

The consumer demand for cigarettes has been decreasing, and Big Tobacco companies are looking to fill these sales gaps with cigarette alternative products. This includes cigars, chew, snuff, and nicotine replacements.

As the dangers of second-hand smoke becomes more prevalent, most areas have in place smoking bans in public places.

Big Tobacco companies are seeking out new products to keep addicted smokers dependent on their habit. Wikipedia defines the newest nicotine delivery devices as dissolvable tobacco products.

Nicotine Alternatives

Dissolvable tobacco products carry a significant risk of nicotine addiction and even poisoning if consumed by kids or teens. Additionally, these products have similar cancer and heart disease risks as traditional tobacco products.

Flavored—to make them taste “less harsh”—as well as dissolvable, these products are made from “finely milled tobacco” and are ingested similar to breath mints.

FDA Concerns

Camel Brand Dissolvable Tobacco ProductsThe FDA’s Center for Tobacco Products (CTP) has expressed its concern with these products to Big Tobacco companies R.J. Reynolds Tobacco Co. and Star Scientific Inc. Because the packaging is brightly colored, appearing like a candy product, and small enough to be easily concealed, the CTP questions the appeal of these products to kids and teens.

The CTP has asked both companies to provide research and marketing documentation on the perception people aged 26 years and younger have towards these products, the age of new users, and information on product misuse.

Tasty Nicotine?

Star Scientific Inc. manufactures the dissolvable tobacco products Ariva and Stonewall. These products, similar in appearance to breath mints, come in wintergreen, coffee, and tobacco flavors. A Star Scientific spokesperson points out that these products provide adult users a tobacco alternative, but are not made to be attractive for non-users.

R.J. Reynolds Inc. produces Camel Orbs (tablets), Camel Strips, and Camel Sticks (toothpick style), all available in mint flavor. A spokesperson for the company stated that not only are their products strictly market to and designed for adults, but they carry the same warnings and age restrictions as other tobacco products.

Camel Orbs are currently being test marketed in Columbus, Ohio, Portland, Oregon, and Indianapolis, Ind.

Big 5 Tobacco File Lawsuit to Fight New Warning Labels

On September 22, 2012, all cigarette packaging and advertising must display one of the FDAs 9 pre-approved graphic and text health warnings.

These labels are designed to discourage youths from smoking and to provide greater appeal for quitting to current smokers.

However, on September 21, 2011 a hearing was held in U.S. Federal District Court regarding the constitutionality of these warnings.

Big Tobacco Files Lawsuit

Five major tobacco manufacturers filed a lawsuit against the FDA on August 16, 2011 in hopes of achieving an injunction against the mandatory implementation of graphic and text warnings on cigarette packages and advertisements.

The tobacco manufacturing companies involved with this lawsuit are:

  • R.J. Reynolds
  • Lorillard Tobacco Co.
  • Commonwealth Brands Inc.
  • Ligget Group LLC
  • Santa Fe Natural Tobacco Co. Inc.

New Cigarette Package Warning LabelsThe tobacco companies’ lawsuit against the FDA was filed on the grounds that the mandatory text and graphic warnings infringed on the constitutional free speech of the tobacco manufacturers. They have asked that the FDAs mandatory implementation be dismissed, and that a new set of warnings that do not threaten their constitutional right be developed. Following this, a new fifteen month waiting period will be set before the new warnings become effective.

The FDA Taken to Court . . . Again

In August 2009, a similar lawsuit was filed on behalf of Discount Tobacco City & Lottery Inc., R.J. Reynolds Tobacco Co., Conwood Co. LLC, Commonwealth Brands Inc., Lorillard Tobacco Co., and National Tobacco Co. The purpose was to have it declared the FDAs proposed graphic and text warnings were unconstitutional.

The judge dismissed the suit, and an appeal was filed. A decision is still pending from the U.S. Circuit Court of Appeals on this case.

Tobacco Manufacturers Argue Warnings Are Unconstitutional

What’s at issue with the tobacco manufacturers is whether or not the FDAs nine warnings portray actual health risks as a result from smoking, or whether or not they stem more from an advocacy perspective.

Tobacco use accounts for more than one in five deaths. Smoking remains the leading cause of cancer-related deaths in America.

Judge Richard Leon’s decision on the injunction is expected by the end of October.

Weak Tobacco Laws in Russia Increase Risk to Women and Children

Gregory Feifer, of Radio Free Europe, Radio Liberty recently published an article on tobacco use in Russia.

He pointed out how the current laws, and heavy regulation and taxes on tobacco products in the West have pressured many smokers to give up their unhealthy habit.

This has had an effect on big tobacco profits in the US causing the industry to seek out new markets to make up losses from the North America and European market.

The Wild West Meets Russia

In Russia, Gregory states this powerful industry is growing stronger every day because, “there are no laws against smoking in public establishments,” taxes are lower, and the attitude of the public is one in which smoking and being of independent character are one in the same. If you remember those old Marboro Man commercials, Russia is reminiscent of those days in the West.

Those who are familiar with the original Marlboro Man, David McClean who appeared in many Marlboro ads starting in the early 60’s died of lung cancer at the age of 73 after it spread to his brain and spine. His widow and son filed a wrongful death lawsuit again Philip Morris, Inc. His tobacco campaign was one of the most well recognized and successful ad campaigns in US history.

Marlboro Man David McCleanNow, big tobacco companies are using the same tactics and preying on the Russian public since they have lost a large share of business. They don’t even have to be creative in their efforts because the Russian tobacco laws and regulation are not in place to protect their citizens from the use of the same old ploys that worked so well in the U.S. and Europe for decades.

As laws here have become stricter large tobacco interests have stepped up their efforts to flood the Russian market and replay their old sales formulas.

Russian Smoking Statistics for Women and Young Smokers

It seems to be working as rates for smokers have risen each year in Russia, especially through targeting women and adolescent smokers.

The laws that have been put in place in Europe and the West, along with the extra taxes on tobacco products, and the new public emphasis on health have made a positive impact. They do help protect citizens from increased use of tobacco.

Russia, according to Gregory Feifer, needs to move forward more quickly to put laws in place to protect the public before these predatory companies become more powerfully entrenched. Soon Russia will be facing a serious epidemic if they aren’t already.

Don’t Put That in Your Pipe and Smoke it

Matt Apuzzo, of the Associated Press reported on a tax loophole that many Big Tobacco manufactures quickly jumped on to reduce their tax base.

By cleverly changing product marketing they are effectively dodging taxes that would have gone to support the cost of children’s health insurance.

It didn’t take long for many makers of tobacco products to catch on. They switched gears immediately to take advantage of the different tax rates between cigarette tobacco and loose pipe tobacco.

Roll-your-own brands of loose tobacco like Criss Cross and Farmers Gold were quickly pulled from the shelves of the tobacco shops. In their place new types of pipe tobacco bearing the same labels almost instantaneously appeared.

We all know those who roll their own cigarettes will purchase the “new varieties” of pipe tobacco to beat the rising costs of smoking cigarettes.

What is most worrisome about this move is pipe tobacco is not banned from adding flavors like tobacco companies did to cigarettes.

Now that new types of flavored pipe tobaccos are finding their way on the shelves, this could ignite a whole new movement for hooking young smokers.

The new varieties of packaged pipe tobacco are also manufactured with a finer cut, suitable for rolling in flavors such as black cherry, vanilla, and who knows what else.

Popeye and his PipeThis move did not go unnoticed; The Obama administration is looking into tightening their definitions so hopefully the funding for children’s health care remains effective. This costly loophole may be causing as much as $32 million dollars of lost tax revenue each month because pipe tobacco sales are rising as roll-your-own sales are drastically being reduced.

The new product campaigns may just offer disposable pipes that go along with disposable lighters combined with packets of flavored tobacco aimed at enticing young smokers. Would it surprise us? No!

60 Research Papers on Toxicity of Smoking Destroyed in 1992 by Imperial Tobacco Company

Report from Canadian Medical Association Journal.

Earlier this month it was reported in an abstract paper by Canadian Medical Association Journal that British American Tobacco had its affiliate, the Imperial Tobacco company destroy over sixty research documents dating back to 1992.

With this action now surfacing the embarrassment for big tobacco could also lead to future litigation due to the implications of the information discovered in the studies.

Studies on Carcinogenics in Cigarettes and Nicotine Addiction

The documents were internal research studies to better understand the effects of smoking cigarettes and offered evidence on the negative and addictive effects of smoking and nicotine addiction.

Specifically the sixty documents focused on cigarette carcinogenics and their addictive nature.

At the time, worries about this information becoming public provoked the destruction of the documents for fear that if the people became less attracted to nicotine the loss of revenue could greatly effect the British American Tobacco giants profits. Also, if the evidence found in the research made its way to government regulators it would most likely lead to regulatory implications and actions that could effect the growth and profits of the industry.

Denying Your Rights to Know

Smoking ResponsibilityIf you are a smoker and think that you haven’t been manipulated into smoking think again.

The proof of the dangers of smoking cigarettes has been known for a long time and it should make you as mad as hell that you weren’t made aware by those dispensing them before you started the habit.

Had you known the facts of these studies you could have made a real choice. Rather than protect the consumer, it is our opinion that Big Tobacco was and still is more interested in creating profits than protecting anyone’s health, or the health of those breathing a smoker’s second hand smoke.

Research Focus on Two Important Points

We need to also mention that two points in the sixty studies revealed that second-hand smoke, especially from low-delivery cigarettes was more toxic than directly smoking, and smoking filtered cigarettes lead to greater smoke inhalation for about the same amount of nicotine intake.

Hopefully uncovering the science in these documents will lead to positive steps for creating greater awareness on the dangers of tobacco addiction as the science behind this news is uncovered and shared with others.

Will New FDA Regulations Backfire and Lend Big Tobacco a Hand?

Government tobacco regulation has been a topic of discussion for years.

Today, the house approved a bill titled, “Family Smoking Prevention and Tobacco Control Act” that would allow the FDA the power to regulate the sale of tobacco products and the ingredients they contain.

For instance, tobacco companies would be banned from adding fruity flavors or additives designed to hook young smokers.

Look Dad, I Can Smoke, Too

pic-candy-ciggysDepending on your age, you may remember the candy cigarettes given to kids. I remember eating them and mimicking my parent’s smoking habits. In those days, the dangers of smoking was downplayed and the uphill battle to expose their risks had not yet kicked in.

Recently, R J Reynold’s Camel No 9 marketing tactics were similar. They aimed their campaign at young women smokers with packaging that is dressed up in pretty pink, a light and luscious slogan, and parties offering gifts. If this bill makes it through congress, perhaps the FDA will take steps to curb actions that attempt to entice young smokers to the negative effects of smoking tobacco products.

We wonder how closely the FDA will view all the harmful additives in cigarettes, and how much of a difference it will make in the end. The FDA does not have a strong track record in keeping toxic substances out of food or personal care products. Therefore, how well will they regulate products we inhale or chew?

Another thing to consider are the existing cigarette ingredients. If they are to be “grandfathered in” like the cheap ingredients found in many personal care products, the FDA could end up allowing more toxic substances in consumer items than they already do.

Imagine the FDA regulation of tobacco products backfiring and thus supporting Big Tobacco’s idea to manipulate FDA regulation by advertising that their products as “FDA Approved.”  This would give people the wrong idea: that there is a safe cigarette.

Hopefully, by the time this bill is approved, it will be well thought out. At least the government is attempting to take the lead in addressing the unchecked power over people’s health that Big Tobacco has had for years.

Times are changing, this is a good thing.

The Winners and Losers – Largest Tobacco Tax Increase

It wasn’t so long ago that Measure 50 was put before a people’s vote in the state of Oregon.

If it had passed, Oregon would have received 85 cents from each pack of cigarettes sold in the state, with the funds marked for children’s health care programs (and other important programs needing funding in the state).

Unfortunately, Big Tobacco’s manipulative tactics and deep pockets sponsored heavy negative campaigns funded by over 11 million dollars donated from the major tobacco companies. They won by swaying the vote.

Tobacco Tax Increase, Largest in History

Today was a historical day. The government passed the largest cigarette tax increase in the history of tobacco taxes. With the passing of this new tax, Big Tobacco lost and the people won.

Most of the revenue created from the new tax will go toward children’s health care. Values are shifting, and steps are being taken to support our children.

This increase brings the federal cigarette tax from 39 cents a pack to $1.01 and it applies to all tobacco products.

Winners and Losers

Lighting UpThe only real loser is Big Tobacco.

Unfortunately, you will hear those who wish to protect Big Tobacco say, “Obama is breaking his promise not to raise taxes.”

Another complaint expressing victimization is: “The majority of smokers are those who are low to middle income. They cannot afford a tax increase in the current economic climate.”

The fact is, people have a choice to smoke or not to smoke. If they don’t want to pay the tax, then they can stop smoking. Perhaps this is just the push they need to finally quit smoking.

Here’s one response to the tax increase quoted in USA Today:

“I’m going to quit,” said Will Hues, 27, smoking a cigarette outside the convenience store. He said prices have gone up so much that “you’re out of your mind to pay it.”

Responses like Mr. Hues’ are some of the best news for those who advocate life. Currently, every eight seconds someone in the world dies from a tobacco-related disease. That is equivalent to twenty-seven 747 airplanes full of passengers crashing every day. Perhaps we will have one less daily crash with this tax increase. The lives saved are not just numbers, but people who will go on to live a better quality life and be able to spend it with their loved ones.

So, if you are one of those who are complaining, then consider moving to South Carolina. The combined state and federal tobacco taxes in SC are only $1.08.

If you have a family member you are trying to get to quit smoking, then you might want to look at relocating to either Rhode Island or New York. These two states have the highest tobacco taxes. Rhode Island’s combined tobacco taxes are $3.47 and New York’s $3.76.

Today is a victory for living a healthy and long life.

Are You ‘For Sale’ on Measure 50 in Oregon

Big Tobacco is sweating this one out after poison-nicotine profits supply $12 millions for subverting Oregon voters.

That old cliche “The nation’s eyes are on you” is quite literally true for Tuesday’s vote. 

Big Tobacco has been forced to wreak out the largest bribe-run of political-ad monies in Oregon’s history, with $12 millions already spent.

Campaign contributions alone may have set up this sequence by providing confrontation within the Legislature, but true-decision still remains right where it should be – with the citizens themselves.

Right or wrong, Oregon’s response may well shape up first the Congressional action on SCHIP –national children’s health insurance– and then foreshadow final action for universal health insurance in this nation, too.

What we DO, here-and-now, will then have strong impact on upcoming rapid decisions for universal health care at the two basic-levels/demanded very soon.

Oregon may very literally lead the nation on this consummately consequential vote.

That fact is making many Oregonians face up irrevocably to their own conscience as they contemplate a very simple choice:

Cheerleader PictureVOTE NO – resoundingly defying and denying the money power never more manipulative -applied than by Big Tobacco, or be side-tracked into submission-AGAIN by the slickly-contrived ads, concentrated on cooking the facts to pervert votes by clearly-crooked presentations-everywhere; with repetition and wide release the keys to subversion of the well known public will.

THINK-again before you act, if you are on the fence over this one.

That expensive flood of tv ads, thrown up over and over again on every Oregon screen, distorts and perverts the actual realities involved here.

That headlong lie in the face of truth is commonplace and always concentrated by the Big T. side; made entirely evident by the rapid-response rebuttal with fact and authoritative statement from supporters of this historic measure.

Well known to those paid profusely to provide propaganda-results, the Big Lie that is repeated provocatively, piled high in every media channel, and pronounced proper-truth by paid authoritative persons– is simply standard procedure since there is nothing else left to provide.

That distorting/perverting overwhelming necessity for Big Tobacco is proven very prominently –over and over again, for all to see and understand– by the extremely revealing list of sponsors supplying the working-dollars for all those ads.

FOR this measure lists every conceivable public-health/service group and working organization; while Opposing lists ONLY Big Tobacco firms, and the ostensibly-local (and surely well-paid !) Big T. servant group necessary to submit the ads.

Huge impacts of nicotine-poison lifetime peonage and permanent lung damage leading to premature death are too solidly and broadly on the public record to be ignored.

In fact that has become such a well known legal fact-of-life that it is widely cited as strong precedent in any new confrontation, as in damage suits now in process covering defective voting machines –surely an ironic note here!

Today everyone knows a relative or friend or associate already so stricken– and now dehumanized by despair and depression– while awaiting a painful death, proven by the millions already so removed.

The danger is not only for smokers but for others whose atmosphere is irrevocably also permeated and poisoned by the irresponsible actions of those so-addicted they are made regardless of decencies and consideration for others.

Those consequences of getting hooked are so widely known that nowadays anyone –even a small/business-owner retailing them– must be keenly aware of what those profits really cost: Irresponsible damage to human life, peddled for pennies of profit by ANYone pandering to the propaganda and pressing approach of Big Tobacco.

Wonder what those-so-involved will answer when their growing child, keyed and informed by education and society generally, will, finally, ask: Why did you sell that poisonous stuff, Daddy?

That same question may well surface (and surely should !) within the family circle of those providing the perverted propaganda so widely seen-and-heard on every Oregon tv-news station and via radio, too.

For those who find themselves involved in helping supply that nicotine-poison today there is only one answer –the same one for any other such poisonous substance on sale once it is clearly and unmistakably so discovered: NO LONGER from me, now that I KNOW the truth.

That ID, infinitely deadly – was made centuries ago, has been known ever since, and was never, ever, allowed to interfere with profit-taking no matter what human costs were concerned.

Our American slavery era, built on Big Tobacco colonial-produced profits, was wiped away only by one of the world’s most excruciating national spasms, costing our struggling nation many deaths and many millions in war costs –with that same war continuing to this very day, in pursuit of the same high levels of profit promised and produced by the absolutely addictive capture always consequential to any personal use.

Those social, cultural, economic and political damages are STILL far from cleared away with ongoing consequences still excruciatingly painful to millions. They carry with them extreme healthcare costs clearly consequential both for smokers and those caught in their miasma.

Those facts are too solidly and surely fully on record –and now too widely circulated to provide conscience-clear continuance for ANYone pursuing further pandering-for-profit from this universally-dangerous nicotine-poison.

Unfair to currently-caught smokers ? WHEN has it ever been unfair to snatch away poison from the hand about to imbibe?

Unwise to add enforcement to Oregon’s Constitution ? WHY, when we have been doing so, in one way or another, ever since 1902?

Oregon’s citizens have long been known for their wit, wisdom and will –so much so I need not even cite examples, well known to most. Will we now prove up that prolonged and continuing protocol?

YOURS may be THE VERY VOTE –with others– to DO THIS JOB NOW in stopping Big Tobacco cold and commensurately censored.

Let’s send them away seething, and make them seek somewhere else to recoup their rapidly-departing power from profits produced, not-so-purely, from poisons provided the unthinking public.
