In a democratic system, citizens can get clear about their values (like the freedom to breath clean air, along with not having to use one's tax dollars on health care caused by smoking) and enact and enforce laws that reflect those societal values. Hitler was also very anti-tobacco. I feel that it is best to encourage people to reduce their use of drugs but probation is just repression.
